Legal policy submission – planning and environment

QLS consults with policy committees, members and other stakeholders on law reform. We regularly invite these stakeholders to provide comment for submissions to parliamentary committees.

Planning and Environment Law Committee
On 12 October 2018, with the assistance of the QLS Planning and Environment Law Committee, the Society made a submission to the State Development, Natural Resources and Agricultural Industry Development Committee in response to the Economic Development and Other Legislation Amendment Bill 2018.

QLS commented on the following:

  • the amendments to the Planning Act 2016, directed at validating infrastructure charges notices (ICN) issued under the repealed Sustainable Planning Act 2009 since 4 July 2014
  • the need for further consultation on the proposed amendment to section 121(3) of the Planning Act under which an ICN must “include or be accompanied by any other information prescribed by regulation”
  • amendments enabling the Planning & Environment Court to refer a matter to a private mediator.
