Titles Registry – list of common requisitions relating to land access agreements

The Queensland Registrar of Titles and Registrar of Water Allocations has provided a common list of errors in requisitions relating to lodgement and removals of land access agreements on certificates of title.

Lodging Conduct and Compensation Agreements

  • incorrect lot on plan description
  • not all lots included (multi-lot titles)
  • title reference not shown
  • general document preparation (e.g. not completing all items where necessary, not including correct interest at item 4)
  • no reference to applicant acting as an agent
  • improper execution (see point above) as well as lack of or incorrect information about the signatory and their authority to sign.

Request to Remove Conduct and Compensation Agreements

  • incorrect lot on plan description
  • title reference not shown
  • lack of dealing number or incorrect dealing number of conduct and compensation agreement to be removed
  • wording in item six did not reflect intent of the request (related to the recording of a new agreement, rather than to a removal).

Practitioners are reminded to be mindful of these errors when submitting requisitions.
