Some exceptions to confidentiality

The duty of confidentially is both a fiduciary duty to the client and an implied term in the retainer. It is an absolute duty that has a number of specified exceptions as set out in Rule 9 of the Australian Solicitors Conduct Rules 2012. Where the protection of children is involved, s 197A of the Child Protection Act (Qld) also permits limited disclosure.
