The new pool safety certificate disclosure regime under the Building and Other Legislation Amendment (No2) Act 2010 affects contracts for the sale of residential property with a pool which settle on or after 1 December 2010. Under the new Act, non-compliance of the provisions of the Act carries hefty penalties. With the main focus on the pre-settlement disclosure obligations, this session canvasses the essence of the legislation and outlines steps practitioners must take to ensure that contracts for sale and purchase comply with the new rules.
