Consultation — Reverse Mortgages Draft Independent Solicitors Certificate and Guidelines

Following the Queensland Law Society reverse mortgages seminar on 19 March 2008 and the call for comments in QLS Update on 8 April, the May edition of Proctor features an article analysing the draft reverse mortgages independent solicitors' certificate and accompanying guidelines which are currently being developed by the QLS Banking and Financial Services Law Committee.

The Committee has developed a draft independent solicitor’s certificate and guidelines for use in advising clients about reverse mortgages. These documents were distributed for comment at the recent reverse mortgages seminar and it is intended to form a settled version for consideration by the Society’s Council in coming months.

Practitioners are invited to comment on the draft independent solicitor’s certificate and the certificate guidelines available below.

In providing feedback, practitioners who were unable to attend the reverse mortgages seminar may also find it useful to review the papers provided by the seminar speakers (Kieren Dell of SEQUAL, Simon Couper QC and Tracy Skellern-Smith of Lexon Insurance) or a DVD of the seminar. These are available on the Resources page.

It is also proposed that a standard diary note will be annexed to the guideline which practitioners might use as a guide when recording their attendance on reverse mortgage borrowers. Comments on the format of such a note would also be most welcome.
