Queensland Law Society Limitation of Liability Scheme

Queensland Law Society has introduced a scheme, approved by the Professional Standards Council and pursuant to the Professional Standards Act 2004 (QLD),that will limit a solicitor’s civil liability against a negligence claim covered by the scheme.

From July 1 2010, members and their practices will be able to join the Queensland Law Society Limitation of Liability Scheme (the Scheme). The Scheme acts to put a limit on liability - so that if a solicitor is sued in court for money, there is a limit to how much the court will award in damages against the person who was liable. For your protection, all solicitors are required to have professional indemnity insurance up to the lowest level of the Scheme cap.

How this affects you

All solicitors who are members of the Scheme have an legal obligation to:

  • clearly disclose to you on their business documents that their liability is limited;
  • be able to tell you the cap on their liability; and
  • be able to direct you to, or pass your concerns on to, the appropriate organisation/person to handle any complaints you may have.

The Queensland Laws Society also has a scheme in place to reimburse you should you suffer financial loss as a result of a default of law practice – the Fidelity Guarantee Fund.
