Terms & Conditions

1. This promotion is being conducted in Queensland ONLY by American Express Australia Limited (ABN 92 108 952 085) and the Queensland Law Society (ABN 33 423 389 441). Information on how to enter and prizes form part of these conditions of entry. Entry into the promotion is deemed acceptance of these conditions of entry.

2. Entry is automatic and is only open to card members with Australian residency who hold an Australian dollar Queensland Law Society American Express Personal Charge, Business or Credit Card (excludes American Express Business Travel Accounts, Government Cads, Corporate Cards, Qantas American Express Cards, David Jones American Express Cards and Corporate Purchasing Cards) billed to an Australian address and issued by American Express in Australia, whose account is current and in good standing (“Eligible Entrant”). Employees, Directors and their immediate families of the promoter and their agencies associated with this promotion are ineligible.

3. Queensland Law Society (QLS) reserves the right to verify the validity of entries and to disqualify any entrant who tampers with the entry process or who submits an entry that is not in accordance with these Conditions of Entry.

4. All Eligible Entrants who pay for their QLS event using their QLS American Express® Card will automatically be entered in the draw for the relevant quarter year. Only one entry per Eligible Entry is permitted per quarter year.

5. Each relevant quarter year for entry purposes commences and concludes on the date below:

i. 1 January 2010 – 31 March 2010

ii. 1 April 2010 – 30 June 2010

iii. 1 July 2010 – 30 September 2010

iv. 1 October 2010 – 15 December 2010

6. The Major Prize draw will take place at 15:00 (AEST) on the following dates after the quarter end at Queensland Law Society, the winner will then be confirmed by American Express. The winner will be notified by telephone and in writing. The draw dates will be:

i. 5 April 2010

ii. 5 July 2010

iii. 5 October 2010

iv. 17 December 2010

7. One prize of AU $1,500 will be allocated to the QLS American Express account within 4 weeks of the draw date of the winner for each quarter year, unless a longer period is agreed by the winner by written confirmation. The total maximum prize pool comprised of all four quarters of the year is AU $6,000.

8. Results of the draws for each quarter will be published in the QLS Update email publication.

9. The promoter’s decision is final and no correspondence will be entered into.

10. The prize is not transferable or exchangeable and cannot be taken as cash in part and/or in full.

11. The promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for personal injury which is suffered or sustained, as a result of taking or using any of the prize, except for any liability which cannot be excluded by law.

12. The promoter is not liable for any tax implications (including any Fringe Benefits or Personal Income Tax) and Cardmembers should seek their own independent financial advice.

13. The promoter is not responsible for any problems or technical malfunction of any telephone network or lines, computer on line systems, servers, or providers, computer equipment, software, technical problems or traffic congestion on the Internet or at any web site, or any combination thereof, including but not limited to any injury or damage to participants or any other person’s computer related to or resulting from participation in or down-loading any materials in this competition.

14. In the event of war, terrorism, state of emergency or disaster The promoter reserves the right (subject to any written directions under relevant lottery legislation) to cancel, terminate, modify or suspend the promotion.

15. Privacy Consent. To provide this competition, The promoter needs to collect personal information about the Eligible Entrant. If the Eligible Entrant does not provide the information requested, The promoter may not be able to provide the Eligible Entrant with the competition entry. The AICD Privacy Policy Statement sets out policies on management of personal information. To arrange access to personal information about the Eligible Entrant, request a copy of the AICD Privacy Policy Statement or enquire generally about privacy matters, write to The promoter The Eligible Entrant agrees that subject to the Privacy Act, The promoter or its agents may:

- transfer personal information confidentially to American Express and organisations that provide services in relation to this competition. This includes transferring personal information to the USA or other countries for data processing and servicing;

disclose the Eligible Entrants' personal information to State and Territory lottery departments;

- publish winners' names as required under the relevant lottery legislation; and

- use the winner's personal information in any media for publicity purposes associated with the competition without any further payment or other compensation, unless the winner otherwise notifies The promoter at time of accepting the prize.

16. The Eligible Entrant agrees to comply with the applicable terms of any permit under relevant lottery legislation.

17. By entering the prize draw, the terms and conditions set out above are acknowledged and agreed to by the Eligible Entrant.
