The Queensland Law Society (QLS) has released a concise, practitioner-focused video to support general practitioners and legal practitioners involved in Queensland Civil and Administrative Tribunal (QCAT) guardianship and administration matters.
Developed in collaboration with RACGP Queensland, the resource is intended to strengthen the quality and timeliness of health professional reports that inform QCAT’s consideration of decision making capacity.
Overview of the resource
The video provides a clear, high-level introduction to:
- the purpose and evidentiary role of health professional reports in QCAT proceedings;
- the legal concept of capacity and its application across different decision types; and
- practical considerations when assessing capacity, including supporting the adult’s participation in decision making.
Rather than offering clinical instruction, the video focuses on areas where clarity and precision are most valuable to the Tribunal, reflecting common issues observed in practice.
Promoting efficient and effective report requests
The resource also addresses how legal practitioners can support general practitioners when requesting reports, emphasising the importance of providing targeted and relevant information from the outset — including context about the matter, the decisions under consideration and the adult’s circumstances.
Clear communication between legal and medical professionals can assist in reducing delays and ensuring QCAT receives focused, reliable material.
