Claim Farming Certificates

Provisions of Personal Injuries Proceedings and Other Legislation Amendment Act 2022 (PIPOLA) outlawing claim farming in respect of workers’ compensation and Personal Injuries Proceedings Act 2002 (PIPA) claims commenced on 30 June 2022, along with changes to the 50/50 rule, as set out in QLS Proctor. This is in addition to the prohibition on claim farming under the Motor Accident Insurance Act 1994 (MAIA), which has been in place since 2019.

Provisions of PIPOLA requiring claimants’ solicitors to supply law practice certificates at various stages of a claim commenced on Monday 31 October 2022. Claimants in PIPA and MAIA matters are also required to provide claimant certificates with their notice of claim.

Updated Law Practice Certificate from 1 September 2025

An updated law practice certificate applicable to Personal Injuries Proceedings Act 2002, Workers Compensation and Rehabilitation Act 2003 and Motor Accident Insurance Act 1994 claims will commence on 1 September 2025.
