LSC Claim Farming Certificates

Provisions of  Personal Injuries Proceedings and Other Legislation Amendment Act 2022 (PIPOLA) outlawing claim farming in respect of workers’ compensation and Personal Injuries Proceedings Act 2002 (PIPA) claims commenced on 30 June 2022, along with changes to the 50/50 rule, as set out in QLS Proctor.

Provisions of PIPOLA requiring claimants’ solicitors to supply law practice certificates at various stages of a claim commence on Monday 31 October 2022. Claimants in PIPA matters will also be required to provide claimant certificates with their notice of claim from 31 October 2022. 

A new law practice certificate applicable to Personal Injuries Proceedings Act 2002, Workers Compensation and Rehabilitation Act 2003 and Motor Accident Insurance Act 1994 claims has been developed.

The LSC has made the law practice certificate and the PIPA claimant certificate available as Word documents so that QLS members may integrate them with their practice software. 

Please note that the claimant certificate for MAIA matters has not changes and remains accessible from the MAIC website.
